Terms and Conditions HoneyHoney and Web Site Agreement Important! These terms of service and terms and conditions govern your use of this site. Please read this document carefully before accessing or using the site. By accessing or using the site, you agree to be bound by the terms and conditions set forth below. If you do not wish to be bound by these terms and conditions, you may not access or use the site.

HoneyHoney may modify this agreement at any time, and such modifications shall be effective immediately upon posting of the modified agreement on the site. You agree to review the agreement periodically to be aware of such modifications and your continued access or use of the site shall be deemed your conclusive acceptance of the modified agreement.

1. Use of the Site Limitation of Liability

In no event will HoneyHoney be liable for (i) any incidental, consequential, or indirect damages (including, but not limited to, damages for loss of profits, business interruption, loss of programs or information, and the like) arising out of the use of or inability to use the service, or any information, or transactions provided on the service, or downloaded from the service, or any delay of such information or service. Even if HoneyHoney or its authorized representatives have been advised of the possibility of such damages, or (ii) any claim attributable to errors, omissions, or other inaccuracies in the service and/or materials or information downloaded through the service. Because some provinces or states do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. In such provinces or states, HoneyHoney liability is limited to the greatest extent permitted by law. HoneyHoney makes no representations whatsoever about any other web site which you may access through this one or which may link to this Site. When you access a non-HoneyHoney web site, please understand that it is independent from HoneyHoney, and that HoneyHoney has no control over the content on that web site. In addition, a link to a or from HoneyHoney web site does not mean that HoneyHoney endorses or accepts any responsibility for the content, or the use, of such web site. We accept no liability, implied, or otherwise, should the use of our products or services cause downtime, loss of earnings or any other negative impacts. We will be more than happy to offer our limited support, assistance and knowledge where possible to resolve any issues your site may have. However, it is you responsibility to ensure that you always have a backup of your site’s files, databases and other information before making any changes.

 

2. Copyright, Licenses and Idea Submissions

The entire contents of the Site are protected by international copyright and trademark laws. The owner of the copyrights and trademarks is HoneyHoney, its affiliates or other third party licensors. YOU MAY NOT MODIFY, COPY, REPRODUCE, REPUBLISH, UPLOAD, POST, TRANSMIT, OR DISTRIBUTE, IN ANY MANNER, THE MATERIAL ON THE SITE, INCLUDING TEXT, GRAPHICS, CODE, PICTURES AND/OR SOFTWARE. You may print and download portions of material from the different areas of the Site solely for your own non-commercial use provided that you agree not to change or delete any copyright or proprietary notices from the materials.

 

3. Indemnification

You agree to indemnify, defend and hold harmless HoneyHoney and any third party information providers to the Service from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of this Agreement (including negligent or wrongful conduct) by you or any other person accessing the Service.

 

4. Liability

We accept no responsibility for any damage or loss of earnings to your blog/site in any instance when using HoneyHoney’s products. It is your responsibility to keep a regular backup of your database and/or relevant files so that if the worst does happen, you can use your backup to bring your blog/site back online.

 

5. Site Access

If you experience a problem that cannot be fixed by following our instructions, it may be required that we access your site to test, isolate and rectify / advise you of our findings. Failure to supply or allow access will result in us being unable to assist you.

 

6. Refund Policy

We want you to be happy with your purchase. If you have any questions, concerns, or problems, please contact us but generally unless the product is defective there is no return policy of goods purchased, especially if the containers/jars/pails/plastic/products have been opened. In cases where the goods are damaged or faulty the client will require to notify us and if HoneyHoney agrees that the defective or faulty product is no fault of the client another equivalent product may be shipped out or picked up as the case may be. No refunds exchanges or replacement products are provided after more than 30 days following purchase.

Raw filtered unpasteurized honey may have small pieces of wax , propolis and the odd time pieces of the actual bee present in the honey such as a very small piece/s of the wing. This is a natural occurrence and does not affect the quality of honey.

The honey will crystallize over time and to liquefy the honey take off the lid off the honey jar and put the entire jar in a double boiler( i.e put honey jar into pot of water and slowly heat the water and jar) . Keep the temp of water very low level, once the honey  melts you are done. Honey never gets old.

 

7. Privacy Policy

All details obtained during registration, ordering or other activity on our site are held with the strictest confidence. We will never sell or give your information to any external companies or sites.

 

8. Affiliate Sales

Anyone found to be committing fraud will have their affiliate accounts suspended and all funds frozen. Affiliate commission will be reversed for refunded sales and will be reported as a negative sale in the sales report.

 

9. Security

Any passwords used for this site are for individual use only. You will be responsible for the security of your password (if any). HoneyHoney will be entitled to monitor your password and, at its discretion, require you to change it. If you use a password that HoneyHoney considers insecure, HoneyHoney will be entitled to require the password to be changed and/or terminate your account. You are prohibited from using any services or facilities provided in connection with this site to compromise security or tamper with system resources and/or accounts. The use or distribution of tools designed for compromising security (e.g., password guessing programs, cracking tools or network probing tools) is strictly prohibited. If you become involved in any violation of system security, HoneyHoney reserves the right to release your details to system administrators at other sites in order to assist them in resolving security incidents. HoneyHoney reserves the right to investigate suspected violations of these Terms of Use.

 

10. Customer Support

We try to reply to all customer emails within 48 hours of posting on weekdays. Our support will be either in person, by email or by phone. As we evolve support may be provided by various social media such as Facebook, Instagram to mention a few.

 

11. Product Delivery

Our products are shipped out individually or as arranged for pick up. If our client has requested that the products be shipped to an address the client is responsible to pay for shipping, any and all customs or boarder clearing costs, broker costs, admin fees etc. if shipped into (United States of America) “USA” or other country unless otherwise agreed to in writing by HoneyHoney. The standard fees for shipping which will appear on checkout is based upon shipping from Hamilton/Burlington, Ontario region to Toronto using Canada Post as of  September 1, 2020. Prices may vary at any time and HoneyHoney may change this rate at any time and add back any increase/s in shipping costs. To ship products to any other locations in Ontario or Canada shall include additional shipping costs which shall apply over and above the shipping costs specified in the checkout price. These terms (shipping costs) will be worked out individually with each client until such time as we can automatically include the complete and accurate shipping costs on checkout. Unfortunately, shipping costs are becoming very significant part of the purchase price if our products are picked up and HoneyHoney is committed to  keeping those costs to a minimum. It is best in our opinion to arrange a time and place to meet such that it will keep costs down for everyone. For example, if I am travelling into Toronto or Welland arranging to meet at certain time and place is ideal. Thank you in advance for your consideration.

12. Terms of Service / Terms & Condition Changes

Changes to our Terms of service and terms & conditions will be made without direct notification. It is your responsibility to ensure you check for changes in our terms of service and terms & conditions.

13. Hive Share program

When a customer purchases a “Hive Share” program from HoneyHoney  the client will require to agree to the terms and condition prior to the paying for the purchase. There will no longer be a separate contract issued but once the terms and conditions have been agreed to this will be binding to the two parties.

The Hive Share program will last for 5 years and end on the end of the fall season of the fifth year. Example, client purchases one hive share in spring of 2019, the program will end  in fall of 2024. If the bees have a great year the 1st year will yield honey however, the honey is usually turned back into the hive so that the second year the  beehive will be in full production in early spring. It usually takes the bees until the second year to produce the projected honey of 32 kg/hive but this will be dependent upon weather, infestation of mites, diseases etc. HoneyHoney will issue a certificate that the client participated in one Hive Share and that a signed copy will be sent out to the client.  The client will be responsible to provide the honey containers at their own expense, notified of same  and any honey produced shall be split 70/30 basis whereby the client gets 70% of the entire beehives honey production. The client must always provide current contact information. If the client wishes to have the beehives on their own property then they will be responsible to comply with all local provincial and federal laws, bylaws, regulations, Health and safety requirement/s and liability insurance.

 

Site visits, nest colony removal 

From time to time HoneyHoney will attempt to remove certain bee colonies and bees nests at places of residences, Condos, trees, retirement homes, Hospitals, government offices or businesses. In order to do so we may have to remove interior walls, outside siding, bricks, soffit, flooring and sometimes dig into the ground to get at the bees nest. In order to remove the bees and the nest the materials will show some minor damage due to nail, screw material, bending, scratches etc.  during the removal process. We can never guarantee that no damages will occur  the materials we are removing or to those around the vicinity. Some damage can be expected, therefore, HoneyHoney shall bear (accept) no responsibilities to ensure that the  materials will be replaced at our cost’s or that it will be replaced without some damage and the client shall assume full responsibility for such minor damage and replacement or repaired as they so wish.  HoneyHoney will do its best to put the materials back as it was prior to the material removal. Bee Rescue or Bee Removal Services

HoneyHoney does not guarantee 100% removal of bees from the Home, Condo, Business, tree, garage, or any other structure where the bees are located. The bees nest or queen or queens under duress can move deeper in the interior of the Home, Condi, Business, tree, garage, or structure without notice. Although, we have been able to remove about 99% of all bees and bee nests without ANY callbacks, there still remains the possibility that the bee removal will not be successful. In such cases there shall be no refunds and any work completed shall be billable at our normal rates (usually quoted during the phone conversation). We don’t charge for the initial phone call.  Bees are considered a wild insect and therefore, unpredictable. In other cases, the bees nest was removed successfully but in rare occasions a new swarm or bee colony could be started in that same space. We attempt to fill the gap/space  with natural product/s but other times we will use steel wool, spray foam or wood  and use wasps spray or soas sprays to get rid of the remaining pheromones.

Sometimes interior walls, soffit, roofing, flooring, windows, doors, overhead framing, carpets, siding, facia, trim, concrete blocks , bricks and cement flooring  etc. herein referred to as “objects” need to be removed in order to get at the bees nest. In such cases additional charges will apply. And we will not be able to replace the “objects” as original or as new because when “objects” are taking and removed they will exhibit small cracks, small chip/s of wood broken off, drywall cut marks, stains from sprays, caulking, paint, cement and scuff marks. Honeyhoney however, attempt to remove the bees nest and “objects” will as best with the least amount of disruption/damage and as thorough as possible. There are limitations to what we can do and the problems and any costs to replace the “objects” as new shall remain solely that of our customers and HoneyHoney is exempt for any additions replacements costs. In cases where Bumblebees, Carpenter bees or yellow jackets are removed they will be driven at least 10 km from their nest location and released. Some bees will die in the course of  removing them, while they are in a container however, our best efforts will be made so that most of them will survive and safely relocated. We attempt to remove the bees naturally however, if the bees pose an immediate risk to other people such as pedestrians, dogs, infants etc.  including our staff we have the option of using chemical spray to kill the bees.

At times the scope of our work will be limited and 3rd party services from outside will be necessary to assist ( for example structure removal, tree removal but not limited herein), in such cases we will discuss the situation with our clients as to which method is most feasible, but in any case the costs associated to the 3rd party service providers shall be that of our clients and discussed with them prior to engaging any 3rd party service providers.
